TERMS AND CONDITIONS

  1. Information on how to participate, claim and the prize(s) form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
  2. In these Terms and Conditions:
  1. The Promoter” is Coopers Brewery Limited (ABN 13 007 871 409) of 461 South Road, Regency Park, South Australia 5010 (PH: 08 8440 1800); and
  2. Spectapular Enterprises” is Spectapular Enterprises Pty Ltd (ACN 151 821 966) of Unit 2A,, 84A Old Pittwater Road, Brookvale NSW 2100.
  1. Entry is only open to Australian residents aged 18 years or over.
  2. Employees (and their immediate families) of the Promoter, Spectapular Enterprise and agencies associated with this promotion are ineligible to participate. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
  3. The promotion will be run at the GABS Festival occurring Brisbane, operated by Spectapular Enterprises (“Participating Venue”). The promotion commences at 12.01am local time on 23 May 2025 and ends at 11.59pm local time on 25 May 2025 (“Promotional Period”). 
  4. To enter the draw,  entrants must do all of the following, during the Promotional Period:
  1. Scan the QR code located at the BrewArt stand at the GABS Festival in Brisbane;
    • Follow the prompts to the promotion entry page and fully complete, in the manner required, the online entry form, including by providing (without limitation) the entrant’s first name, last name, current and valid email address, mobile phone number, profession, gender and age;
    • Correctly answer the prescribed question contained in the entry form;
    • Successfully submit the fully completed entry form, in the manner required.
  1. For clarity, all valid entries received from winners and non-winners are eligible to enter the unclaimed prize draw (if any).
  1. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence), based on the information provided to it, and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, submitted an entry not in accordance with these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
  2. Incomplete or indecipherable entries will be deemed invalid.
  3. Costs associated with accessing the Promotional Website, or otherwise engaging in the Promotion, remain the responsibility of the entrant and may vary depending on the internet service provider used.
  4. Multiple entries from the same entrant are not permitted and entrants can only enter in their own name. Entrants who provide incorrect, misleading or fraudulent information are ineligible to participate in the promotion and all entries of an entrant who is deemed by the Promoter to have provided incorrect, misleading or fraudulent information may, at the discretion of the Promoter, be deemed invalid. The Promoter reserves the right to request the entrant produce any reasonable information in order to confirm the entrant’s identity and eligibility to enter or claim a prize. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or an entrant or entry has not been verified or validated to the Promoter’s satisfaction, then the entry of that entrant will be ineligible and deemed invalid.
  5. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant. A prize will only be awarded following any validation and verification of an entrant’s identity that the Promoter requires in its sole discretion. Prizes will only be awarded where the entry fulfils all of the requirements of the Promoter's verification tests and procedures. The verification tests and procedures shall be determined by the Promoter in its absolute discretion.
  6. Entries will be deemed accepted at the time of receipt by the Promoter and not at the time of transmission. Entries received will be considered final by the Promoter. The Promoter accepts no responsibility for late, lost or misdirected entries. Errors or omissions in entries may be accepted at the Promoter’s sole discretion.
  7. The total number of prizes to be won is one (1). The prize consists of one (1) BrewArt Personal Brewing System, consisting of one (1) BeerDroid product, one (1) BrewFlo product, one (1) complete kegging pack, one (1) BrewPrint of the winner’s choice and one (1) BrewArt Multitool, valued at $1,788 RRP (inc. GST). The total prize pool for this promotion is $1,788.00 RRP (including GST).
  8. One (1) individual winner will be drawn. The identifiable entrant of the entry form must be the collector of the prize. The Prize will be delivered to the winner, to the address provided by the winner, once they have accepted the Prize and provided information required.
  1. The draw will take place at Coopers Brewery, 230 Regency Rd, Regency Park SA 5010 on 28 May 2025 at 10:00AM AEST. The first valid entry drawn will win the prize as advertised in the Promotion. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. 
  1. This Promotion is a game of chance, and the winner will be drawn randomly from eligible entries in accordance with paragraph 17 of these Terms and Conditions. The first eligible entry drawn will win. The Promoter's decision is final and no correspondence will be entered into. 
  2. The winner will be notified in writing via email within seven (7) business days of the draw and their names will be published at https://brewart.com/au/termsconditions no later than 14 June 2025.
  3. If the Promoter is unable to contact the winner within seven (7) business days of the draw and the Promoter has made every reasonable effort to contact them with the information provided by the entrant, then the Promoter may, at its sole discretion, award the prize to another valid entrant.
  4. A draw for any unclaimed prizes (if no valid additional reserve entries have been draw pursuant to paragraph 17), may take place on 20 June 2025 at the same time and place as the original draw, subject to any directions from a regulatory authority. The winner (if any) will be notified in writing via email within seven (7) business days of the new draw and their names published online at https://brewart.com/au/termsconditions no later than 5 July 2025.
  5. Subject to the unclaimed prize draw clause, if for any reason a winner does not take a prize by the time stipulated by the Promoter, then the prize will be forfeited.
  6. If a prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize at their discretion with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
  7. Prizes are not transferable or exchangeable and cannot be taken as cash unless otherwise specified. The prize values are correct as at the date of preparing these Terms and Conditions and include any applicable GST. The Promoter is not responsible for any change in prize value.
  8. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention. r fraud, an event of war or terrorism, state of emergency, pandemic or any other kind of disaster, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, or suspend, substitute or modify the prize as appropriate.
  9. The use of any automated entry software or any mechanical, electronic or other means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant as invalid.
  10. The Promoter encourages consumers to enjoy alcohol responsibly. Legal aged consumers are advised to consider the safe drinking levels recommended in the National Health & Medical Research Council Australian Alcohol Guidelines that are available at www.nhmrc.gov.au
  11. Nothing in these Terms and Conditions limits, excludes or modifies, or purports to limit, exclude or modify, the statutory consumer guarantees as provided for under relevant Competition and Consumer legislation of each jurisdiction, as well as any other implied warranties under the ASIC Act (or similar consumer protection laws in the States and Territories of Australia, or New Zealand) (“Non-Excludable Guarantees”). 
  12. Except for any liability that cannot be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including for negligence), for any personal injury, or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of or as a result of participation in the promotion, and:
  1. Any technical difficulties or equipment malfunction (whether or not under the Promoter’s control), delays or failures, including those resulting from accessing any materials related to this promotion and any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion as a result of any technical malfunctions, delays or failures;
  2. Any theft, unauthorised access or third-party interference;
  3. Any entry or price claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
  4. Any variation in prize value to that stated in these Terms and Conditions; or
  5. Any tax liability incurred by the winner or entrant;
  1. As a condition of accepting the prize, each winner may be required to sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form. Failure by a winner to produce properly signed legal documentation required by the Promoter and/or prize supplier will result in that winner forfeiting the prize.
  2. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media (including the Promoter’s Social Media) for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  3. The Promoter collect personal information (“PI”) in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its privacy policy, which can be viewed at https://coopers.com.au/privacy. In addition to any use that may be outlined in the privacy policy, the Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The privacy policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. Entrants should direct any request to opt out, access, update or correct information to the Promoter. Promoter. 
  4. Spectapular Enterprises may also use and handle PI as set out in its privacy policy (which can be viewed at https://gabsfestival.com/privacy-policy/). The Promoter may disclose PI obtained during this promotion to Spectapular Enterprises. Any queries relating to Spectapular Enterprises’ use and retention of PI (including how to opt out, access or update PI) should be directed to Spectapular Enterprises directly. The Promoter accepts no responsibility for Spectapular Enterprises’ use or retention of PI. 

 

  1. An entry and any copyright subsisting in an entry irrevocably becomes, at time of entry, the property of the Promoter. The Promoter collects PI about an entrant to include the entrant in the promotion and, where appropriate, award a prize. If the PI requested is not provided, the entrant cannot participate in the promotion and is deemed ineligible.

Each entrant acknowledges and agrees that the promotion and these Terms and Conditions are governed by the laws of South Australia, Australia and each entrant submits to the non-exclusive jurisdiction of the courts of South Australia, Australia and any courts competent to hear appeals from those courts.
