The Coopers USA, Inc., a Delaware corporation, on behalf of itself and its subsidiaries, including Coopers DIY, LLC, (collectively "Coopers," "us" "our" or "we") respects your privacy and is committed to protecting it through this privacy policy (the "Privacy Policy").  BrewArt is a brand of products produced and sold by Coopers, and may be used for other aspects of marketing and sales of our products (such as through our Sites).

This Privacy Policy describes how we collect, use, store, share and protect personal information in connection with our websites (collectively, the "Site"), and our products, services and tools related to the Site (including, but not limited to, mobile and other software applications downloaded from the Site or obtained elsewhere, including any mobile applications, such as the Brewart App (collectively, the "Coopers Application"), and the Coopers Application with other products, services and tools related to the Site shall be referred to herein, collectively, as the "Services"). 

This policy applies to any information we collect about you, including through the Site or Services, any emails, texts or other electronic communications sent through the Site or Services, as well as any offline interactions we have with you.   

This policy DOES NOT apply to information collected through any other apps or websites (including websites you may access through the Sites or Services) or by any third party.  These other websites, apps or third parties may have their own privacy policies, which we encourage you to read before providing information through them.

  1. Changes to Our Privacy Policy.

We may update our Privacy Policy from time to time.  If we make material changes to how we treat your personal information, we will post the new privacy policy on this page.  Your continued use of the Site or Services after we make changes will be subject the then-current Privacy Policy as published.  The date that this Privacy Policy was last revised is identified at the top of the page. 

 

  1. Intended for Adult Users.

The Site and Services are not intended for anyone under 21 years of age, and we do not knowingly collect personal information from anyone under 21 years of age. If we learn we have collected or received personal information from an individual under 21, we will delete that information.   1. Information We Collect and How We Collect It.

We collect information from and about users of our Site and Services in the following ways:

  • Directly from you when you provide information to us.  When you access or use the Site or Services, or otherwise contact us, we may ask you to provide personal information, such as name, postal address, email address, telephone number, credit or debit card details, product purchase history, brewing and beer preferences, personal photograph or any other information we might collect that is defined as personal data or personal information under applicable law ("Personal Information").  This information may include: 
    • information you provide by filling in forms on the Site and Services when you register, enter contests and promotions, or report a problem with the Site or Services;
    • records and copies of our correspondence (including email addresses and phone numbers), if you contact us;
    • your responses to surveys;
    • details on transactions you carry out through the Site or Services, such as purchases of products on the Site; or 
    • your search queries on the Site or Services. 

You also may publish or display information on public areas of the Site, Services or related websites ("User Contributions").  Your User Contributions are posted and transmitted to others at your own risk.  We cannot and do not guarantee that your User Contributions will not be viewed or otherwise used by third parties.

  • As part of your use the Site or Services.  When you download, access or use the Site or Services, we may collect:
  • usage details (including your internet browser history, traffic data, location data, communication data and the resources you access and use through the Site and Services);
  • device information (including IP address, operating system, browser type, hardware ID, mobile network information and the device's telephone number);
  • stored information (including metadata and other information associated with the files stored on your device, such as photographs, audio and video clips, personal contacts and address book information); and
  • location information (including real-time information about the location of your device). 

  We also may use, or work with third parties who use, cookies and similar technologies to collect information about your activities over time and across third-party websites, apps or other online services (behavioral tracking). See the “Information about Our Cookie Use” and “Information about Analytics and Advertising” sections below for additional information on how our Site may use automated technologies to process information.

  • From third parties. Occasionally, we may collect personally identifiable information about you from third parties, including our service providers and affiliates.  For example, we may collect information regarding your mobile app download or purchase history if this information is made available to us by an entity which operates a mobile app store from which you have downloaded the Coopers Application. 

 

  1. How We Use Your Information.

We use information that we collect about you or that you provide to us, including any personal information, to:  

  • provide you with the Site and Services and their contents, and any other information, products or services that you request from us, including customer support (such as troubleshooting or providing brewing instructions or tips to you);
  • fulfill any other purpose for which you provide it;
  • give you notices about your account and seek your feedback on our Site and Services;
  • carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection;
  • notify you when updates are available, and of changes to any products or services we offer or provide through the Site and Services;
  • carry out marketing initiatives and analysis; and
  • link products purchased from us with your contact details.

The usage information we collect helps us improve our Site and Services and deliver a better and more personalized experience by enabling us to estimate our audience size and usage patterns, store information about your preferences, customize our Site and Services according to your individual interests, speed up your searches, and recognize you when you use the Site or Services.

 

  1. Disclosure of Your Information.

We may disclose aggregated information about our users.  Also, we may disclose your personal information to:  

  • our subsidiaries and affiliates;
  • contractors, service providers and other third parties we use to support our business and who are contractually bound to keep your personal information confidential and only use it for purposes for which we disclose it to them;

  1. Additional disclosures related to collection, use, and disclosure of personal data for residents of certain states.

To the extent applicable, certain states, including Texas, require us to provide additional disclosures and consumer rights with respect to our collection, use, and disclosure of personal data.  The information in this section is provided as a supplement to the rest of the information provided in this Privacy Policy.  Please read the entire Privacy Policy for a full description of our privacy practices.

The personal information we collect about you includes information within the below categories of data.  The categories of data listed below refer to the categories of personal information that we have collected, and how it has been shared, over the past 12 months.  Inclusion of a category in the list below indicates only that we may collect some information within that category.  We do not necessarily collect all information listed in a particular category, nor do we necessarily collect all categories of information for all individuals. 

We have disclosed personal information in each of the below categories with our affiliates and service providers, as well as with government entities as necessary, for our business purposes within the last 12 months.  We have not necessarily shared all information listed in a category.  We have also shared your Internet or other electronic network activity information (as described further below) with our advertising partners, including for purposes of targeted marketing.  To limit the sharing of your personal information for targeted advertising purpose, you can change your cookie settings to turn off advertising cookies in your browser settings. You may also have the right to opt out of the processing of personal information for purposes of targeted advertising by submitting a privacy right request.

Information that identifies, relates to, describes, or is capable of being associated with, a particular individual, including, but not limited to, your name, signature, address, telephone number, passport number, driver’s license or state identification card number, education, employment, employment history, credit card number, debit card number, or any other financial information,

In addition to the categories of personal data above, we collect and  process account log-in information to administer your relationship with us, including establishing and managing your account, meeting our legal obligations, and providing you with benefits and services, as applicable. It is also processed in order to help detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, and for compliance management.

 

  1. Retention of Personal Information.

We consider the following criteria when determining how long a particular record will be retained, including any personal information contained in that record:

  • How long the record is needed to provide you with the products and services you request
  • How long the record is needed to support and enhance our operational processes
  • How long the record is needed to protect our rights and legal interests
  • How long the record must be retained to comply with applicable laws and regulations

The same personal information about you may be included in more than one record and used for more than one purpose, each of which may be subject to different retention periods based on the factors listed above.

 

  1. Your Privacy Rights.

Depending on your state of residency, and the type of data collected, you may have rights with respect to your personal information.  We may choose to extend these rights to you even if we are not required to under applicable law.

  • Right to access/know – You may be entitled to request that we disclose to you the personal information we have collected about you, including the categories of personal information, the categories of sources from which we collected the information, the business or commercial purposes of collecting the information, the categories of third parties with whom we have shared the information, and the categories of personal information that we have shared with third parties for a business purpose. In some instances, you may have the right to receive the information about you we have collected in a portable and readily usable format.  Before providing any of this information, we must be able to verify your identity.
  • Right to data portability – Subject to certain conditions, you may be entitled to request that we disclose to you the personal information we have collected about you in a portable, and to the extent feasible, usable format that allows you to transmit the data to another entity without hindrance.
  • Right to correct – Subject to certain conditions, you may have the request that we correct any mistakes in your personal information or update your preferences; however, we may not be able to accommodate your request if we believe it would violate any law or legal requirement or cause the information to be incorrect. We may delete the contested personal information as an alternative to correcting the information if the deletion of the personal information does not negatively impact you, or you consent to the deletion.
  • Right to deletion – Subject to certain conditions, you may be entitled to request that we delete personal information about you. Before deleting information, we must be able to verify your identity.  We will not delete personal information about you when the information is required to fulfill a legal obligation, is necessary to exercise or defend legal claims, or where we are required or permitted to retain the information by law.  For example, we cannot delete information about you if your personal information is on the contract between us for our services or products.
  • Right to opt-out of the processing of personal information for targeted advertisingWe currently do not “sell” personal information to third parties, but we do process and share personal information for cross-context behavioral advertising, as those terms are understood under applicable law. You can limit this collection and use of personal information in several ways. When you first accessed our website, you were notified of this Privacy Policy and our use of cookies, including the use of advertising cookies. You may change your cookie choices through your browser settings..  We also recognize universal opt-out signals that automatically opt you out of any cookies or signals for the purposes of targeted advertising. You can control your opt-out preferences within your internet browser’s settings. We do not control third parties' collection or use of your information for interest-based advertising; however, these third parties may provide you with choices relative to your personal information as well. You may also have the right to opt out of the processing and sharing of your information for cross-context behavioral advertising by submitting a privacy request consistent with the instructions below.
  • Right to limit use and disclosure of sensitive personal information – We only process sensitive personal information for purposes considered necessary under applicable law, and therefore do not offer this option.
  • Right to non-discrimination – You may have the right to not be discriminated against for exercising any of the above-listed rights. We may, however, provide a different level of service or charge a different rate reasonably relating to the value of your personal information.
  • Right to opt out of receiving our marketing emails. To stop receiving our promotional emails, follow the instructions in any promotional message you get from us. If you object to our use of your information for direct marketing purposes, please email us at digital@coopers.com.au.  Even if you opt out of getting marketing messages, we will still send you transactional messages.  These include responses to your questions.
  • Right to limit how we use cookies and tracking tools. We will use cookies or tracking tools in accordance with this Policy, and information on how to limit or control this usage is explained herein.

We do not discriminate against you if you choose to exercise any of these rights.  If we deny your request, you may have the right to appeal our decision with regard to your request by using the “Contact Us” details provided at the end of this policy.

Depending on your residency, these rights may not apply to pseudonymous data if the information necessary to identify the consumer is kept separately and is subject to controls that prevent access to the information.  Pseudonymous data is personal data that can no longer be attributed to a specific individual without the use of additional information, if the additional information is kept separately and is subject measures to ensure that personal data is not attributed to the specific individual.

Data solely retained for data backup or archive purposes is principally excluded from these rights until it is restored to an active system or next accessed or used for a sale, disclosure, or commercial purpose.

Please note that under applicable privacy law, we are only obligated to respond to personal information requests from the same consumer up to two times in a 12-month period.  In addition, under applicable privacy law, and for the protection of your personal information, we may be limited in what personal information we can disclose.

To the extent applicable, we will maintain all of your Consumer Data Rights requests for at least 2 years.  This information will not be used for any other purpose except to review compliance processes; it will not be shared except as necessary to comply with a legal obligation. 

You may also be entitled to request in writing a list of the types of personal information that we have disclosed to a third party for their direct marketing purposes during the preceding year and to whom that information was disclosed. We will use all reasonable endeavors to produce such a list, in a timely manner.

You can exercise your privacy rights by submitting requests to us to exercise those rights and by taking other steps that will limit how information about you is collected, used, and shared.

We must verify your identity before fulfilling your personal information request.  To verify your identity, we may collect information from you, including, to the extent applicable, your name, date of birth, contact information, your account information, or other personal identifying information.  We will match this information against information we have previously collected about you or against information available from consumer reports to verify your identity and to respond to your request.  Information collected for purposes of verifying your request will only be used for verification and to respond to your personal information request.  If you maintain an account with us, we may require you to log in to that account as part of submitting your request.

If we are unable to verify your identity as part of your request, we will not be able to satisfy your request.  We are not obligated to collect additional information in order to enable you to verify your identity.  For deletion requests, you will be required to submit a verifiable request for deletion and then confirm separately that you want personal information about you deleted.

If you would like to appoint an authorized agent to make a request on your behalf, we require you to verify your identity with us directly before we provide any requested information to your approved agent.  Alternatively, your authorized agent may provide evidence of having power of attorney or acting as a conservator for you.  Note that we may require you to verify your identity with us directly before we provide any requested information to your authorized agent unless your authorized agent has power of attorney or acts as a conservator, in which case we will not contact you directly.  We may also request that any authorized agents verify their identity and may reach out to you directly to confirm that you have provided the agent with your permission to submit the request on your behalf.  There may be circumstances where we will not be able to honor your request.  For example, if you request deletion, we may need to retain certain personal information to comply with our legal obligations or other permitted purposes.  We will notify you if we are unable to honor your request. 

Based on your residency, you may have the right to appeal our decision with regard to your request by using the “Contact Us” details provided at the end of this policy.

 

  1. Information about our cookie use

We may use browsing information we collect (including IP address, email address and data received services such as Google Analytics, Google Signals or Meta Pixels) to match with information received from third parties (including behavioral information and device identifiers) and customer information to learn more about an individual or a group.  These actions help us analyze interactions with our website, improve marketing efforts, inform our strategic approach and improve your experience.  We also may use this information to directly market our products and services, to the extent permitted by law.  We may use third parties to perform these and other activities.

We also enable cookies to be placed or accessed on your device by third party advertising networks.  These kinds of persistent cookies remember the websites you visit, and that information is shared with other parties, such as advertisers.  We may use third-party advertising networks to help us deliver tailored online ads to you.   1. Information about Analytics and Advertising.

We engage others to provide analytics services and serve advertisements on our behalf across the web.  These entities may use cookies, web beacons, device identifiers, and other technologies to collect information about your use of our websites, including your IP address, web browser, pages viewed, time spent on pages, links clicked, and conversion information.  This information may be used by Coopers and others to, among other things, analyze and track data, determine the popularity of certain content, deliver advertising and content targeted to your interests on other websites, and better understand your online activity.  For more information about interest-based ads, or to opt out of having your web browsing information used for behavioral advertising purposes, please visit www.aboutads.info/choices. To opt-out of the use of advertising cookies on our website specifically, please review and update your browser settings.

We also work with third parties to serve ads to you as part of customized campaigns on third-party platforms (such as Facebook). As part of these ad campaigns, we or the third-party platforms may convert information about you, such as your email address and phone number, into a unique value that can be matched with a user account on these platforms to allow us to learn about your interests and serve you advertising that is customized to your interests. Note that the third-party platforms may offer you choices about whether you see these types of customized ads. Once again, to opt-out of the use of advertising cookies on our website, please review and update your browser and/or platform (i.e. Meta, Google, etc.) settings.

 

  1. Do Not Track.

Various third parties are developing ways for consumers to express their choice about the collection of the individual consumer’s online activities over time and across third-party websites or online services.. We endeavor to honor requests made using the Global Privacy Control (“GPC”) signal as requests to opt out of the sharing of Personal Information, with respect to any Personal Information connected to the GPC opt out request based on the information made available by GPC, to the extent required by applicable law. Note that we may not be able to tie a GPC request to all Personal Information we have about you, and despite best efforts, may not be able to honor all GPC requests.

 

  1. Data Security.

We implement measures designed to protect your personal information from accidental loss or unauthorized access, use, alteration or disclosure.  However, the safety and security of your information also depends on you.  We urge you to protect your user information and password and to be careful about giving out information in public areas of the Site or Services, which may be viewed by other users of the Site or Services.

Unfortunately, transmitting information via the internet and mobile platforms is not completely secure.  We cannot guarantee the security of your personal information when transmitted through our Site or Services.  Any transmission of personal information is at your own risk, and we are not responsible for circumvention of any privacy settings or security measures we provide.

The Site and Services are designed for and intended for use only by individuals located within the United States. If you live outside of the United States, you understand and agree that we may transfer your information to the United States.
